FUSIONPAY Terms of Use Agreement

1. Definitions

• "FusionPay", "we", "our", or "us" means My Fusion International PTE. LTD.

• "User", "you" means any individual or entity accessing our Services.

• "Services" means all features, products, and functionalities provided via FusionPay, including but not limited to digital wallets, cryptocurrency payment infrastructure, and integrations with third-party providers.

2. Use of Services

• Users must be at least 18 years of age or the legal age in your jurisdiction to use our Services.

• You agree to use the Services only for lawful purposes and in accordance with these Terms.

• You are responsible for your own digital wallet, including secure management of passwords, private keys, and recovery phrases.

3. Account and Wallet Security

• FusionPay does not store users' private keys or wallet credentials.

• Users are solely responsible for maintaining the confidentiality and security of their credentials.

• Any losses due to unauthorized access caused by user negligence will not be the responsibility of FusionPay.

4. Third-Party Services

• FusionPay integrates services provided by third-party providers (e.g., Alchemy Pay).

• We are not responsible for the reliability, accuracy, availability, or any malfunction of third-party services.

• Users agree to be bound by any additional terms and conditions of such third-party services.

 

5. Risk Disclosure and Disclaimer

• The cryptocurrency market is volatile and unpredictable. By using our Services, you acknowledge that any transactions made through FusionPay involve substantial risk.

• My Fusion International PTE. LTD disclaims all warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

• We provide the platform on an "as is" and "as available" basis, with no guarantees regarding uptime, security, or performance.

 

6. Limitation of Liability

• To the fullest extent permitted by law, FusionPay shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or relating to your use of or inability to use the platform.

• This includes but is not limited to loss of digital assets, data, profits, goodwill, or business opportunities.

 

7. User Conduct

• You agree not to use our Services for any unlawful activities, including but not limited to money laundering, terrorism financing, or fraud.

• We reserve the right to report any suspicious activity to regulatory authorities.

 

8. KYC, AML and Compliance

• You may be required to undergo Know Your Customer (KYC) and Anti-Money Laundering (AML) checks.

• FusionPay may suspend or terminate your access to Services at any time if you fail to pass compliance checks or are found to be in violation of applicable laws.

 

9. Intellectual Property

• All content on the platform, including logos, designs, texts, graphics, and software, is owned by My Fusion International PTE. LTD or its licensors.

• You may not reproduce, distribute, or use any of our intellectual property without prior written consent.

 

10. Indemnification

• You agree to indemnify and hold harmless FusionPay, its affiliates, and employees from any claim, demand, or damages arising from your use of the Services or your violation of these Terms.

 

11. Service Modifications and Termination

• We reserve the right to modify or discontinue any part of the Services at any time without prior notice.

• We may terminate or suspend your account if you breach these Terms, misuse the Services, or if required by law.

 

12. Amendments

• We may revise these Terms at any time. The updated version will be effective as of the date it is posted on our website.

• Continued use of the Services after changes are made constitutes your acceptance of the updated Terms.

 

13. Governing Law

• These Terms shall be governed by and construed in accordance with the laws of the Republic of Singapore.

• Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the Singapore courts.
